Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the ComplyFlame fire safety compliance management platform ("Service"), operated by ComplyFlame Ltd ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Service Description

ComplyFlame provides a digital platform to assist property managers, landlords, and businesses in managing their fire safety compliance obligations under the Regulatory Reform (Fire Safety) Order 2005 and related UK legislation. The Service includes digital logbooks, compliance calendars, document storage, regulatory record management, and compliance reporting tools.

Important: ComplyFlame is a compliance management tool, not a substitute for professional fire safety advice. You remain solely responsible for ensuring your properties comply with all applicable fire safety legislation. We do not provide fire risk assessments, fire safety consultancy, or legal advice.

3. Account Registration

To use the Service, you must create an account by authenticating through our supported sign-in providers. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4. Free Trial

Each new property added to the Service receives a 14-day free trial period. During the trial, you have full access to all features for that property. After the trial expires, you must subscribe to a paid plan to continue using logbook, calendar, document, and regulatory record features for that property. We reserve the right to modify or discontinue the free trial at any time.

5. Subscription and Payment

The Service operates on a per-property subscription model. Pricing is tiered as follows: £20 per property per month for 1–10 properties, £15 per property per month for 11–25 properties, and £10 per property per month for 26 or more properties. All prices are in British Pounds Sterling (GBP) and are exclusive of VAT where applicable.

Payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis. You may cancel your subscription at any time through the Service or by contacting us, and cancellation will take effect at the end of the current billing period.

6. Refund Policy

We offer a 14-day free trial so you can evaluate the Service before committing to a paid subscription. As such, we do not generally offer refunds for subscription payments. However, if you believe you have been charged in error, please contact us within 14 days of the charge and we will review your case.

7. Your Data and Content

You retain ownership of all data, documents, and content you upload to the Service ("Your Content"). By uploading content, you grant us a limited licence to store, process, and display Your Content solely for the purpose of providing the Service to you. We will not share, sell, or use Your Content for any other purpose.

You are responsible for ensuring you have the right to upload any content to the Service and that Your Content does not infringe any third-party rights.

8. Acceptable Use

You agree to use the Service only for its intended purpose of fire safety compliance management. You must not: use the Service for any unlawful purpose; attempt to gain unauthorised access to the Service or its systems; interfere with or disrupt the Service; upload malicious software or content; or resell or redistribute the Service without our written consent.

9. Service Availability and Limitations

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, and the Service may be temporarily unavailable due to circumstances beyond our control. We shall not be liable for any loss arising from Service unavailability.

10. Limitation of Liability

To the maximum extent permitted by law, ComplyFlame shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

Fire safety compliance disclaimer: The Service provides tools to help you manage compliance records and deadlines. It does not guarantee compliance with any legislation. You are solely responsible for ensuring your properties meet all legal requirements. Failure to comply with fire safety legislation may result in criminal prosecution, fines, or imprisonment — the Service does not protect against these outcomes.

11. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of Your Content within 30 days of termination by contacting us.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
